NUR IKHWAN alias WAWAN yang diduga melakukan<br \/>\npenganiayaan sebagaimana termaktub dalam Pasal 362 KUHP yang diancam dengan hukuman penjara selama-lamanya 5 (lima) tahun.<br \/>\nBerdasarkan Pasal 1 Ayat (1) Perja Nomor 15 Tahun 2020 Tentang Penghentian Penuntutan<br \/>\nBerdasarkan Keadilan Restoratif pengertian Keadilan Restoratif adalah penyelesaian perkara tindak<br \/>\npidana dengan melibatkan pelaku, Korban, keluarga pelaku\/Korban, dan pihak lain yang terkait untuk<br \/>\nbersama-sama mencari penyelesaian yang adil dengan menekankan pemulihan kembali pada keadaan<br \/>\nsemula, dan bukan pembalasan.<br \/>\nAlasan untuk dihentikan berdasarkan<br \/>\nkeadilan restoratif, karena terpenuhi syarat sebagai berikut:<br \/>\na. Tersangka baru pertama kali melakukan tindak pidana;<br \/>\nb. Tindak pidana diancam dengan pidana penjara tidak lebih dari 5 (lima) tahun;<br \/>\nc. Korban memaafkan perbuatan Tersangka;<br \/>\nd.
