Alasan yang menjadi pertimbangan dilakukannya upaya Restorative Justice atas Tersangka HERWADI Alias PAWADI Alias PAWADI berdasarkan Pasal 5 PERJA RI No. 15 Tahun 2020 Penghentian Penuntutan Berdasarkan Keadilan Restoratif:
\n– Perbuatan HERWADI Alias PAWADI Alias PAWADI melanggar Pasal 80 Ayat (1) Jo Pasal 76C Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, yang mana ancaman pidana 3 (tiga) tahun dan 6 (enam) bulan (tidak melebihi 5 tahun);
\n– Telah adanya niat dari kedua belah pihak (Tersangka HERWADI Alias PAWADI Alias PAWADI dan pihak korban) untuk berdamai;
\n– Korban dan keluarga korban telah memaafkan Tersangka;
\nKorban tidak akan menuntut penyelesaian perkara melalui proses persidangan;<\/p>\n

Telah terjadi perdamaian bersyarat yaitu :
\nTerjadi perdamaian apabila Tersangka mencabut laporan Pasal 362 KUHP terhadap Anak Berhadapan dengan Hukum dan telah mencabut laporan tersebut;
